By accessing or using MyAIStays (“the Platform”), operated by MyAIStays LLC (“we,” “us,” “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
MyAIStays is a software platform that enables vacation rental hosts (“Hosts”) to create branded direct booking websites and connects guests (“Guests”) with vacation rental properties. We are a technology provider, not a travel agency, property manager, or real estate broker.
We do not own, manage, or control any properties listed on the Platform. We do not guarantee the quality, safety, or legality of any listing. All bookings are agreements between the Host and the Guest.
You must be at least 18 years old and capable of forming a binding legal agreement to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
All payments are processed through Stripe Connect. We are a platform facilitator — we do not hold guest funds. Payments flow directly from the Guest to the Host’s connected Stripe account, minus applicable processing fees and platform fees (if any).
Each property has a cancellation policy set by the Host (Flexible, Moderate, Firm, Strict, or Non-refundable). Refund eligibility is determined by the applicable cancellation policy and the timing of cancellation relative to the check-in date. See each property’s listing page for specific policy details.
When a cancellation is eligible for a refund, the deposit is returned. When ineligible, the deposit is non-refundable. The balance (charged after check-in) is never charged if the Guest cancels before arrival.
Guests may leave reviews only after completing a stay (at least one night). Reviews must be honest, accurate, and based on the Guest’s personal experience. We reserve the right to remove reviews that violate these guidelines, are fraudulent, or are flagged and confirmed as abusive.
Hosts may delete a Guest’s review only if the associated booking has been fully refunded. Hosts may flag reviews for platform review at any time.
The Platform, including its design, code, and branding, is owned by MyAIStays LLC. Hosts retain ownership of their property photos, descriptions, and brand content. By uploading content to the Platform, Hosts grant us a non-exclusive, royalty-free license to display that content on the Platform and in marketing materials.
To the maximum extent permitted by law, MyAIStays shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to property damage, personal injury, loss of revenue, or disputes between Hosts and Guests.
Our total liability for any claim shall not exceed the amount of fees paid by you to MyAIStays in the 12 months preceding the claim.
You agree to indemnify and hold harmless MyAIStays, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in the State of Florida, in accordance with the rules of the American Arbitration Association. You waive the right to participate in a class action lawsuit.
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify registered users of material changes via email.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
